Trump’s increasing “desperation” is more evident, claims a former prosecutor, and adds, “The clock is ticking”

Late-night filings by Trump’s legal team are a sign of desperation, warned former U.S. Attorney Joyce Vance and gave an interesting insight into his defense.

Trump’s legal team’s efforts

Attorney and former federal prosecutor Joyce Vance wrote in her Substack column about Trump’s gag orders. She dubbed the recent series of actions taken by his lawyers as a sign, writing, “The clock is ticking, and Trump is increasingly transparent about his desperation to delay his criminal trials until after the election.”

“While the appeal of the gag order shouldn’t slow things down, what’s coming behind it are the four motions to dismiss Trump has filed (presidential immunity plus three others, which we will take up next week), some of which he can appeal before trial if he loses.” Vance continued.

“With the gag order, Trump has asked the court to decide a motion in a week. It’s certain that if he returns to the appellate court seeking rulings on some of those motions, he’ll be content to see the courts take up as much time as possible, and preferably until after election day in 2024, to render their decision and return the case for trial,” the attorney added.

Trump’s lawyers claim the order is “muzzling President Trump’s core political speech during a historic presidential campaign.” But Vance fired back, “There’s never been a need for such an order before in our nation’s history because no former president nor candidate has been so criminal-minded.”

The lawyers in the D.C. case filed a motion writing, “The prosecution’s request for a Gag Order bristles with hostility to President Trump’s viewpoint and his relentless criticism of the government—including of the prosecution itself.”

Trump’s legal team added, “The Gag Order embodies this unconstitutional hostility to President Trump’s viewpoint. It should be immediately stayed.”

Message for the courts

Vance warned, “Delay when it helps him, speed when it harms him. Certainly, the courts can see through that?” She added that there is “a large reality gap between what Trump claims the order does and what it, in fact, restricts him from doing.”

Trump’s “modest” gag order

The attorney also wrote that Trump was given a “modest restraining order.” As a reminder, Trump was prohibited from going after the prosecutor and potential witnesses.

The Judge was clear

However, in the D.C. case, Judge Chutkan did not mention her safety and told him he could attack the White House and other political opponents but not those involved in the case. Chutkan repeated numerous times she does not want politics in her courtroom.

Still, the gag was paused again

A three-judge appeals court panel paused the federal gag order that partially limited the former president. This is the second time he got a gag order paused.

Each decision could affect the trials

“Each of these developments — the trial schedule in D.C., the appeal of the gag order in that case, and the Special Counsel’s decision to push hard on Judge Cannon to avoid being sucker-punched by Trump’s lawyers’ maneuvering will be highly significant to the outcome of these trials,” Vance concluded.

Trump will “be content to see the courts take up as much time as possible, and preferably until after election day in 2024, to render their decision and return the case for trial,” Vance reminded.
