“No business having those documents:” Former White House attorney predicts Trump will end up in jail, “there’s so much evidence”

Ty Cobb, a lawyer during the Trump administration, claims that the former president will end up in jail due to the alleged mishandling of classified documents.

Cobb, who was a White House lawyer in 2017 and 2018, talked to CNN and explained that the National Archive’s recent decision to hand over 16 records to the Justice Department shows that Trump knew he was not permitted to take documents to his Mar-a-Lago mansion. Cobb told CNN, “I would not necessarily expand the case to try to prove the Espionage Act piece of it because there is so much evidence of guilty knowledge on the espionage piece.”

The former White House attorney continued, “All they really have to do is show that Trump moved these documents at various times when DOJ was either demanding them or actually present, that he filed falsely with the Justice Department, had his lawyers file falsely with the Justice Department, an affidavit to the effect that none existed—which was shattered by the documents that they then discovered after the search—and the many other misrepresentations that he and others have made on his behalf with regard to his possession of classified documents.” I think this is a tight obstruction case,” Cobb said and concluded, “Yes, I do think he will go to jail on it.”

Bill Barr shared similar beliefs

Barr, Attorney General under the Trump administration, shared Cobb’s thoughts. The former Attorney General said to CBS, “It’s very clear that he had no business having those documents. He was given a long time to send them back. And they were subpoenaed.”

Barr mentioned Biden and Pence

The lawyer further noted, “I’ve said all along that he wouldn’t get in trouble, probably, just for taking them, just as Biden, I don’t think is going to get in trouble or Pence is not going to get in trouble.” But the issue lies elsewhere.

Barr continued, “The problem is, what did he do after the government asked for them back and subpoenaed them? And if there’s any games being played there, he’s going to be very exposed.”

Trump’s argument

Since the FBI’s raid of Trump’s residence, the 45th president argued that he could automatically declassify any document. He repeated these claims recently while talking to CNN during their Town Hall meeting.

Trump told CNN that “they become automatically declassified when I took them.” In an interview with Fox anchor Bret Baier, Trump said he was too busy to deal with the boxes, as he explained, “Because I had boxes, I wanted to go through the boxes and get all of my things out.” Trump continued, “I don’t want to hand that over to NARA yet. And I was very busy, as you’ve sort of seen.” Rolling Stone claims that his lawyers “watched on with exasperated sighs and in some cases terror.”

The former Attorney General elaborated

Bill Barr shared, “I don’t think the idea that you know, he automatically — that they were somehow automatically declassified when they were put in the boxes.” He concluded, “I don’t think that will fly.”

Trump is losing lawyers

Timothy Parlatore, pivotal in the Mar-a-Lago classified documents investigation, left the former president. He claimed it was a “personal choice,” adding, ” I believe strongly the (Justice Department) team is engaging in misconduct to pursue an investigation of conduct that is not criminal.” Palm Beach State Attorney Dave Aronberg said, “What stood out with the departure of Tim Parlatore is that he is the same lawyer that wrote a letter to Congress setting up Trump’s defenses.”

Trump’s hands were allegedly clean

Aronberg added how Parlatore said it was “Trump’s aides, not Trump, who hastily packed up the boxes and shipped them down to Florida — Trump’s hands were supposedly clean.”

But the former president contradicted that statement

Aronberg believes that Trump’s critical lawyer removed himself because of Trump’s CNN interview, where Trump said, “‘No, no, I did it and had every right to do so.” Regarding his Fox interview, a Rolling Stone source said, “Where Trump saw the buzz, people hoping to keep him out of legal jeopardy saw trouble. Several of the ex-president’s current and former legal advisors watched on with exasperated sighs and, in some cases, terror, according to three people familiar with the matter.”

The State Attorney concluded, “I think the reason why he withdrew, Parlatore, is because he was exasperated with his client along with perhaps knowing that he would become a witness and possibly a defendant in the case himself — he testified about before the grand jury.” The trial is set for May 2024.
